Judge Pro Tempore, Orleans Parish Civil District Court, Division C, April B October 2004

1. What is the depth of your experience in Civil District Court? Number of jury trials? Number of judge trials?

Judge Pro Tempore of Division C in Civil District Court, Parish of Orleans from April 2004 through October 2004. During my six-month tenure I presided over 4 jury trials. I presided over hundreds of civil matters including judge trials, injunctions, administrative reviews, a receivership, interdictions, constitutional challenges, judicial commitments, protective orders, and discovery matters. I read every memorandum that was submitted to me prior to any hearing. I only relied upon my law clerk to bounce matters off of her. I wrote my own reasons for judgment within hours after a trial. I did my own research. My law clerk was Michele who works for Judge Cates if you would like to confirm. I am a board certified civil trial advocate by the National Board of Civil Trial Advocacy. This is a voluntary certification program recognized by the American Bar Association. This required me to demonstrate substantial involvement in trying jury and judge trials. I had to demonstrate participation in close to 15 jury trials; examination of 50 lay witnesses at trial; and examination of 30 expert witnesses. I had to demonstrate substantial participation in 40 other contested matters. The certification required a peer review from lawyers who I tried cases against, references from judges who I appeared before and a rigorous written examination.

2. Have you ever been subject to a disciplinary ruling by the Office of Disciplinary Counsel, the Judiciary Commission or the Louisiana Bar Association? If yes, explain.

3. How will you avoid the public perception that attorney contributions to judicial elections lead to favoritism in judicial rulings?

Under our judicial canons a candidate is prohibited from knowing who has donated and how much has been donated to his or her campaign. Additionally, the perception of improprieties is truly greater with litigants who make donations and come into the courtroom. If there is a matter which I have an interest in I am duty bound to recuse myself. If a party or attorney suggests that I cannot be fair they have the option of filing a Motion for Recusal. Under the Louisiana Code of Civil Procedure that matter is immediately reallotted to another judge for a hearing.

4. Do you favor the consolidation of the civil and criminal courts?

Under our judicial canons I cannot comment on the propriety of legislation. I will handle any matter that comes before me.

5. How would you like to see the consolidated court system organized? For example in the areas of assignment of cases, specialty courts or management of funding?

See previous answer. The only matters that I can comment on are matters which improve the administration of justice. My philosophy in practice has been to move my cases to a conclusion either through trial or settlement in a timely and efficient fashion. I have spoken with many attorneys who want the same thing. They want a judge who will read the law, treat lawyers and litigants with respect, and give litigants closure by ruling on matters in a timely and just fashion.
