IN 500 WORDS OR LESS PLEASE DISCUSS WHICH RESPONSIBILITY OF THIS OFFICE YOU CONSIDER TO BE THE MOST IMPORTANT AND WHAT YOU PLAN TO DO TO MEET THAT RESPONSIBILITY?
The most important responsibility of the Judge of Municipal Court for The City of New Orleans is to ensure the fair and impartial administration of justice to all who appear before the court without regard to social status.
To accomplish this objective the Judge must be timely with court attendance. The Judge must be efficient with use of the Court's time and the Judge must be courteous and respectful of all. Additionally, the Judge must be patient to hear and consider the admissible evidence that each side will present to either prove or cast doubt upon the facts and circumstances of the transaction or occurrence allegedly constituting the offense.
Once the evidence has been admitted the Judge must weigh and consider all the evidence drawing upon his evaluation of the veracity of the witnesses and the plausibility of the witnesses' statements. Once this is done, a Judgment of Guilty or Not Guilty should be rendered unless there exists the possibility of a lesser included offense.
If a defendant is found guilty or pleads guilty the Judge must sentence the defendant. The maximum sentence is generally five months in jail or up to a five hundred dollar ($500.00) fine or both. It is important that the Judge sentence the defendant appropriately considering the defendant's past record, age, education, and the facts and circumstances of the offense charged. The Judge should be harsh when necessary and compassionate when the facts require it. The sentence imposed should serve both the defendant and the community. For this reason, I propose the use of less jail time and more alternative sentencing. By this I mean community service through city agencies and non-profit agencies. Also, alternative sentencing may be comprised of vocational training or educational requirements. The objective of alternative sentencing is for the defendant to contribute to the community, rather than only draw from the community. Hopefully, the community as a whole will derive benefit from the defendant's education and/or community service.
I, as Judge, will draw upon my nineteen years of experience as a defense attorney in Municipal Court, my nine years of experience as a City Prosecutor in Municipal Court, and my appointment by the Louisiana Supreme Court as Judge ad hoc in Municipal Court to provide for the fair and impartial administration of justice to all who appear before the Court.
If funds become available I, as Judge, would attempt to secure additional attorneys so as to provide additional consultation and further protect the Constitutional rights of all defendants.
